Please read these Terms and Conditions carefully before placing an order. By purchasing a custom watercolor portrait from us, you agree to be bound by these terms.

1. General Terms

These Terms and Conditions govern your purchase of custom watercolor dog portraits from our business. By placing an order, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement.

2. Custom Orders

2.1 Order Process

  • All portraits are custom-created based on the photo(s) you provide

  • You are responsible for ensuring the quality and suitability of photos submitted

  • We reserve the right to decline orders if the submitted photos are of insufficient quality for creating a portrait

2.2 Photo Requirements

  • Photos must be clear, well-lit, and high-resolution

  • You must own the rights to the photo or have permission from the copyright holder to use it

  • By submitting a photo, you confirm you have the legal right to use the image for this purpose

2.3 Artistic Interpretation

  • Each portrait is an artistic interpretation created in our signature watercolor style

  • While we strive for accuracy, portraits are artistic renderings and may not be photographic replicas

  • Color variations may occur between digital previews and printed products due to screen calibration and printing processes

3. Pricing & Payment

3.1 Prices

  • All prices are listed in USD

  • Prices are subject to change without notice, but orders already placed will honor the price at the time of purchase

  • Shipping costs are calculated at checkout and are additional to the product price

3.2 Payment

  • Payment is required in full at the time of order

  • We accept major credit cards and other payment methods as displayed at checkout

  • All payments are processed securely through our payment provider

4. Production & Delivery

4.1 Processing Times

  • Digital portraits: 5-7 business days

  • Printed and framed portraits: 8-12 business days before shipment

  • Processing times are estimates and may vary during peak periods or holidays

4.2 Delivery

  • Digital portraits are delivered via email

  • Physical products ship from North Carolina with tracking

  • Shipping times vary by location and are estimates only

  • We are not responsible for delays caused by shipping carriers or customs

4.3 Lost or Undelivered Packages

  • If a tracked package shows as delivered but you haven’t received it, please contact the shipping carrier first

  • We will assist with claims for lost packages but cannot guarantee replacement or refund for carrier errors

5. Revisions & Approval

5.1 Preview & Revisions

  • You will receive a digital preview of your portrait before final delivery/printing

  • One round of minor revisions is included (color adjustments, background changes, small details)

  • Revision requests must be submitted within 48 hours of receiving your preview

  • Major changes requiring substantial rework may incur additional fees

5.2 Approval

  • By approving the final design or not responding within 48 hours, you accept the portrait as final

  • Once approved, no further changes can be made

6. Refunds, Returns & Cancellations

6.1 Cancellations

  • Orders may be cancelled for a full refund before artwork production begins

  • Once production has started, orders cannot be cancelled

  • Contact us immediately if you need to cancel

6.2 Digital Products

  • Digital portrait sales are final once delivered

  • No refunds or exchanges are available for digital products

6.3 Physical Products

  • Physical products cannot be returned due to their custom nature

  • Damaged or defective items will be replaced at no cost (see section 6.4)

  • Dissatisfaction with artistic interpretation is not grounds for return or refund

6.4 Damaged or Defective Products

  • Report damaged or defective items within 7 days of delivery with photographic evidence

  • We will replace damaged items at no additional cost

  • Damage must occur during shipping; customer damage after delivery is not covered

7. Intellectual Property & Usage Rights

7.1 Your Rights

  • Upon full payment, you receive the right to use your custom portrait for personal, non-commercial purposes

  • You may print, display, and share your portrait for personal use

  • You may not resell, redistribute, or use the portrait for commercial purposes without written permission

7.2 Our Rights

  • We retain the copyright to all artwork created

  • We reserve the right to display your portrait in our portfolio, marketing materials, and social media

  • If you prefer your portrait not be shared publicly, please notify us at the time of order

7.3 Prohibited Uses

  • You may not claim the artwork as your own creation

  • You may not alter, modify, or create derivative works from the portrait for commercial use

  • You may not use the portrait in any way that is unlawful, harmful, or offensive

8. Liability & Disclaimers

8.1 Limitation of Liability

  • Our liability is limited to the amount you paid for your order

  • We are not liable for any indirect, consequential, or incidental damages

  • We are not responsible for color variations between digital and printed products

8.2 No Warranties

  • Portraits are provided “as is” without warranties of any kind

  • We do not guarantee that the portrait will meet your specific expectations beyond reasonable artistic standards

9. Privacy

We are committed to protecting your privacy. Personal information collected during the order process (name, email, address, photos) will only be used to fulfill your order and communicate with you about your purchase. We will not sell or share your information with third parties except as necessary to process and ship your order.

10. Communication

By placing an order, you consent to receive emails regarding your order status, previews, and delivery information. You may also receive occasional promotional emails, which you can unsubscribe from at any time.

11. Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, internet outages, or government actions.

12. Amendments

We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated “Last Updated” date. Your continued use of our services after changes constitutes acceptance of the modified terms.

13. Governing Law

These Terms and Conditions are governed by the laws of the State of North Carolina, United States. Any disputes shall be resolved in the courts of North Carolina.
